The petitioner is aggrieved by the order dated 18.11.2022 wherein the learned Additional Sessions Judge expressed dissatisfaction regarding physical production of the present accused.

The petitioner is directed to serve a copy of this revisional application upon Mr. Pravas Bhattacharya, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Whether an accused would appear virtually or physically is an exclusive discretion of the administration of the criminal court. If the petitioner intends to appear physically, the petitioner should take out an application before the jurisdictional sessions court who is in seisin of the matter. The jurisdictional sessions court will express its reasons for either allowing or rejecting such application for physical appearance. If such an application is preferred by the petitioner within a month from date, the learned court would dispose of the same at the earliest.

With the aforesaid observations, the revisional application being CRR 82 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
