Matter is heard in presence of the learned advocates representing the petitioner and State respondents.

Learned advocate representing the petitioner submits that a representation was made on 11th December, 2025 before the Sub-Divisional Police Officer, Kandi, Murshidabad but the same did not yield any result prompting the petitioner to approach this Court with the present writ petition. 3.

A direction is prayed for in this writ petition thereby mandating the concerned police authorities to take steps in order to protect the right of the petitioner over the land in question. 4.

Learned advocate representing the State respondents has filed a communication dated 3rd February, 2026 of Officer-in-Charge, Bharatpur Police Station, Murshidabad Police District enclosing certain documents and same are taken on record.

It is disclosed in the communication dated 3rd

February, 2026 that relating to similar issue involving land in question another writ petition was filed being WPA 628 of 2025 (Bulu Sk. @ Seikh Bhulu Rahaman & Anr. v. The State of West Bengal & Ors.) and an order was passed by a coordinate Bench on 20th January, 2025 disposing of the writ petition. Copy of the order dated 20th January, 2025 is enclosed to the communication dated 3rd February, 2026.

On perusal of the order dated 20th January, 2025 it appears that issue involved in this writ petition was already considered by the coordinate Bench and an order was passed disposing of the writ petition being WPA 628 of 2025 thereby directing the concerned police authority to keep strict vigil over the land in question and ensure that no breach of peace or tranquility takes place.

Furthermore, taking note of the ad interim order of injunction dated 12th February, 2024 passed in connection with Title Suit No.71 of 2023 the coordinate Bench granted leave to the concerned police authority to seek further clarification from the civil court in the event it was found necessary. 8.

In view of the order passed on 20th January, 2025 Court finds on identical issue no further order need be passed as it is found there is no accrual of subsequent cause of action excepting one representation was filed by the present petitioner

dated 11th December, 2025 before the SubDivisional Police Officer, Kandi, Murshidabad. 9.

Hence, the present writ petition stands dismissed.
