The petitioner is a visually impaired person his deceased father was an Assistant Teacher of a Higher Secondary School. The mother of the petitioner had predeceased the father.

The petitioner is praying family pension.

Mr. Acharyya, learned advocate for the petitioner submits that the District Inspector of Schools (S.E), Purba Medinipur, the respondent no.3 herein, by a letter dated September 15, 2023 had asked the petitioner to supply the documents mentioned therein. The Service Book of the concerned teacher was not available as such the other papers were sought to be submitted before the respondent no. 3 through the school but the said respondent refused to accept the same without the Service Book. Mr. Acharyya files photocopy of the said letter, let it be kept with the record.

Mr. Ali, learned advocate for the State submits that the said Service Book has been traced, it is lying with the respondent no.3, as such the petitioner is now required to submit the other papers.

The petitioner is directed to submit the papers/documents mentioned in the said letter dated September 15, 2023 except the Service Book with the said respondent no. 3.

The said respondent on receipt of the said papers shall take steps for disbursement of the family pension in favour of the petitioner as expeditiously as possible preferably within a period of eight weeks from the date of receipt of the said papers.

W.P.A. 501 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
