In pursuance to the order by this Court the administrative notice was served upon the sole appellant and the respondent of this second appeal. The registered consignment of the administrative notice is returned with the mark in respect of sole appellant Mrs. Gita Roy as "deceased".

It appears from the memo of the appeal that late Amarendranath Roy was the sole appellant of the instant appeal. On demise of the said appellant Ms. Gita Roy was substituted at his place. Registered consignment reflected that the sole substituted appellant Ms. Gita Roy has died. Accordingly, the instant second appeal became abated. Accordingly, the instant second appeal is dismissed for default.
