....for the State Two applications for bail were disposed of by an order dated March 17, 2022 where we directed a police complaint be lodged and a separate complaint be lodged with the Bar Council as against the advocate.
The order dated March 17, 2022 was mentioned at the instance of the State on December 11, 2023 pursuant to which, the matter was directed to be placed in our list on December 12, 2023.
On December 12, 2023 noting the submission on behalf of the State, we called for a status report from the learned Registrar General.
Learned Registrar General submitted a report dated December 14, 2023 which is in the record. We perused such report.
On perusal of such report, we find that, police complaint pursuant to order dated March 17, 2022 was lodged with the Hare Street Police Station under cover of a letter dated April 8, 2022 by the Registrar General.
Learned advocate appearing for the State submits that on receipt of such letter, police registered the First Information Report being Hare Street FIR No.113/22 dated May 14, 2022 under Sections 174/ 177/ 181/ 182/ 187/ 188/ 200/ 205/ 209 of the Indian Penal Code, 1860.
The report dated December 14, 2023 also states that, complaint with the Bar Council of West Bengal was also lodged. Same report states that status report were called for from the police as also the Bar Council and that no response was received either from the Bar Council or from the Officer-inCharge of the Hare Street Police Station. Learned advocate appearing for the State submits that the advocate concerned is being investigated into pursuant to order of the coordinate Bench in Kandi Police Station FIR No.600/23 dated October 4, 2023.
The coordinate Bench directed investigation by the Criminal Investigation Department.
It would be appropriate that the same team of C.I.D investigate into the Hare Street FIR No.113/22 dated May 14, 2022.
State will submit a report as to the progress made in Hare Street FIR No.113/22 dated May 14, 2022 before the coordinate Bench when the matter relating to Kandi Police Station Case No.600/23 dated October 4, 2023 is taken up.
