06.02.2023 Court No.13 Item No14 pk WPA 510 of 2023 Kanchan Sanyal Vs.

State of West Bengal and others Mr. Supriyo Chattopadhyay Mr. Sandip Kumar Maity ... for the petitioner The writ petitioner complains of alleged over action by the Durgapur Police Station. It is submitted that there are civil disputes being negotiated between the petitioner and his brother with regard to ownership of title of their late father's property at Netaji Nagar Colony, Benachity.

Counsel for the petitioner submits that even without any formal complaint from any of the brothers, Durgapur Police Station has sought to intervene in the civil dispute.

The Durgapur Police has submitted that they received a complaint from one Sadhana Sanyal/wife of late Gautam Sanyal, who is the brother of the petitioner. The said Sadhana Sanyal has been prevented from entering into her maternal house by the petitioner.

The Durgapur Police has, in its wisdom, found the dispute to be civil in nature and rightly so. Only a G. D. entry has been made.

In the above circumstances, the petitioner's allegation of over action by the police is baseless and is rejected.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
