The petitioner says that a public road has been constructed on his land without due compensation being paid to him therefor. This is the crux of the petitioner's grievance.

The District Magistrate, Birbhum, being the respondent no.3 herein, is directed to consider the contents of this writ petition along with the annexures thereto as a representation of the petitioner and dispose of the same by a reasoned order in accordance with law within a period of six weeks from the date of receipt by him of a copy of this order along with a copy of the writ petition, after giving an opportunity of hearing to the petitioner or his authorized representative and other interested parties, if any. The decision so taken shall be communicated to the petitioner within a week from the date of the decision.

If the respondent no.3 is satisfied that the petitioner has a legitimate grievance, appropriate orders will be passed by the respondent no.3 so that the petitioner's grievance may be redressed.

Since I have not called for any affidavit, the allegations contained in the writ petition are deemed not to be admitted by the respondents.

WPA 600 of 2021 is, accordingly, disposed of. Urgent Photostat Certified copy of this order, if applied for, be supplied expeditiously after complying with all necessary legal formalities.
