In terms of the order dated 13th February, 2024 a report of the District Inspector of Schools (SE), Malda is placed before this Court which is communicated vide memo dated 25th February, 2025 to the learned advocate for the State respondents and same is taken on record.
However, the learned advocate representing the petitioner submits that concerned State authority has released arrear dues on sanctioning graduate scale of pay for his M.M. qualification from the date of his appointment on 23rd April, 1999. But there is delay in releasing arrear dues since time was stipulated by the coordinate Bench vide order dated 8th September, 2016 passed on the first writ petition being WPA 14197 of 2008.
It is submitted that arrear dues have been paid to the petitioner but he is entitled to receive interest due to delay caused in releasing arrear
dues.
In view of release of arrear dues writ petition stands disposed of.
Leave is granted to the petitioner to make a representation to the District Inspector of Schools (SE), Malda seeking interest on arrear dues if arrear dues have not been paid within the time specified by the coordinate Bench in the order dated 8th September, 2016.
If such representation is made by fortnight from date the District Inspector of Schools (SE), being respondent no.3 shall take decision in accordance with law within a period of eight weeks thereafter, after granting opportunity of hearing to the petitioner and the school authority.
The decision to be taken by the respondent no.3 shall be communicated to the petitioner by ten days thereafter.
However, there shall be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
