1. Ms. Sanyal, learned Advocate appearing for the respondent Bank, submits that the writ petition has become infructuous as the auction notice dated December 22, 2020, which had been challenged in the writ petition, was withdrawn, due to inadequacy of bidders and a fresh notice was issued and the concerned property had, thereafter, been sold and possession was handed over to the highest bidder.

2. A copy of the forwarding letter by which the Sale Certificate was handed over as well as a copy of the Sale Certificate dated May 21, 2021, produced in Court are kept on record.

3. In view of the aforestated, the writ petition has become infructuous and is dismissed.

4. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
