The petitioner is directed to add the Chief Manager (Personnel), Kolkata Municipal Corporation as the respondent no.7 here and now.

The petitioner contends that as per an order dated June 24, 2019, prepared by the Department of Urban Development and Municipal Affairs (Municipal Affairs Branch), Government of West Bengal containing the list of candidates, eligible to be appointed to the post of Hearing Officer, under the Corporation, the name of the petitioner appeared at serial no.39, but the Kolkata Municipal Corporation appointed persons, whose names appeared at serial nos.40, 41 and 42.

Allegation is of superseding the petitioner, despite the petitioner having a higher position in the panel/rank list. The petitioner is directed to make a detailed representation before the added respondent within a week

from date. If such representation is made, the same shall be considered in accordance with law and on the basis of the panel/order dated June 24, 2019. The petitioner shall be heard. A reasoned order shall be passed and communicated to the petitioner.

The entire exercise shall be completed within a period of four weeks from date of receipt of the representation of the petitioner.

If it is found that the petitioner has been left out by mistake, then steps to rectify such mistake shall be taken by the Corporation.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the learned advocate's communication.
