The petitioner was awarded a Work Order dated 29.11.2019 for construction of a swimming pool near Rabindra Bhawan in the district of Bankura under the PUP fund.

It is the case of the petitioner that he has completed some portion of the work and his outstanding amount of Rs.14,58,090.00 is pending with the respondent no.3.

Learned counsel for the petitioner submits that the bill has been duly verified by the District Engineer on 19.3.2020 and that he is entitled for the reimbursement of the said amount of Rs.14,58,090.00. Learned counsel for the respondent disputes the said fact. Learned counsel for the respondent states that it is purely contractual dispute and the present writ petition is not maintainable.

Be that as it may, the learned counsel for the petitioner states that he shall be satisfied if his representation dated December 14, 2023 is considered by the respondent no.3 by affording an opportunity of hearing.

In view thereof this Court hereby directs the respondent no.3 to decide the representation of the petitioner dated 14.12.2023 within a period of eight weeks after affording an opportunity of hearing to the petitioner and a speaking order shall be passed. A copy of the said order shall be supplied to the petitioner. Needless to state that the petitioner shall be at liberty to challenge the same in accordance with law.

With the above direction, the present writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied expeditiously after compliance with all the necessary formalities.
