Mr. Mit Guha Roy, Mr. Sayan Sarkar, Ms. Sneha Saha ...for the petitioner Petitioner has prayed for a direction upon the Court below for expeditious disposal of the Complaint Case being AC 2857 of 2023 presently pending before learned Judicial Magistrate, 4th Court, Alipore.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the plea was recorded on 07.02.2025. He further submits that the petitioner/complainant has also filed one application under Section 143A of the Negotiable Instrument Act. Neither the said application filed under Section 143A has been disposed of nor the Court below has recorded evidence of any witness since then. He further submits that the matter has practically stalled since recording of plea and, therefore, he seeks appropriate direction upon the Court below on the ground that the accused has taken dilatory tactics in disposal of the said proceeding within the period prescribed in the statute.

Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having considered the submissions made on behalf of the petitioner that the proceeding has been stalled since 07.02.2025, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 133 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
