Sabyasachi Bhattacharyya, J.:

1. The learned Advocates for the parties submit that the parties have arrived at a settlement, the terms of which have been

reduced in writing and marked as Annexure-"A" to CAN 2 of 2025.

2. On a perusal of the said terms of settlement, we find that the same are otherwise in order and in accordance with law.

3. Accordingly, CAN 2 of 2025 is allowed, thereby disposing of FMA No. 124 of 2025 in terms of the settlement as reduced in writing and marked as Annexure- "A" to CAN 2 of 2025.

4. Let the said terms of settlement be treated to be a part of this order.

5. CAN 1 of 2025 stands disposed of accordingly as well.

6. Interim order, if any, stands vacated.

7. The parties are at liberty to approach the trial Court and seek the disposal of the suit, from which the present appeal emanates, in terms of the settlement arrived at by the parties.

8. There will be no order as to costs.
