Pradip Chakraborty and others Mr. Siddheswar Chandra Mr. Sandip Datta ... for the petitioner This revisional application has been filed by the defendants for expeditious disposal of the Title Suit No.862 of 2019, pending before the learned Judge, 13th Bench, City Civil Court at Calcutta.

It is submitted that the ad interim order of injunction which was passed ex parte in favour of the plaintifs, has been extended from time to time, but the said application has not yet been disposed of.

It is further submitted that the application for vacating the ad interim order of injunction and the application for amendment of the written statement, are also pending.

Under such circumstances, this court is of the view that justice would be subserved if the learned court below is directed to dispose of the pending applications as the learned court below may deem fit and proper, but within a period of 3 months from the next date fixed.

This court has not gone into the merits of the suit. An order of expeditious disposal of any

litigation, enures to the benefit of all the parties. Hence, prior service of this revisional application upon the opposite parties would not be necessary. The prayer is innocuous.

It is also requested that the learned court below shall make all necessary endeavour to dispose of the suit within the following year after disposal of the applications. Unnecessary adjournments to either of the parties shall not be granted.

Petitioners are directed to serve a copy of this revisional application along with the server copy of this order upon the opposite party.

Accordingly, the revisional application is disposed of.

All the parties are directed to act on the basis of the server copy of this order.
