Ct. 19 sg Mr. Bibek Jyoti Basu Mr. Uttam Kumar De ...for the petitioners Mr. Lalit Mohan Mahata, AGP Mr. Ziaul Haque ...for the State The petitioners have prayed for a direction upon the respondent authorities to consider and dispose of the representation of the petitioners dated 11th December, 2024 praying for allotment of a vested plot for continuing business. Mr. Mahata, learned Additional Government Pleader, raised an objection as to the maintainability of this writ petition. He submits that the petitioners have alleged inaction on the part of an authority under a specified Act. Faced with such situation, Mr. Basu, learned Counsel appearing for the petitioners, prays for leave to withdraw this writ petition with liberty to approach the appropriate forum. In the light of the submissions made by the learned Advocates for the respective parties, WPA 755 of 2026 stands dismissed as withdrawn with liberty to the petitioners to approach the appropriate forum in accordance with law on the self-same cause of action.

In the event such an application is filed, this Court expresses the hope and trust that the same shall be considered and disposed of expeditiously.
