Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case for alleged recovery of 5.1 litre of codeine mixture. Learned advocate for the petitioner also submits that the petitioner is in custody since 16.06.2025 and charge-sheet has been submitted.

Learned advocate for the State opposes the prayer for bail and submits that the other accused person who has been granted bail is absconding for the present.

Be that as it may, learned trial court would split up the trial of the case, if required.

Petitioner is in custody for more than seven months. Having considered the period of detention of the

petitioner, I am of the opinion that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sahid Gazi shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District and Sessions Judge, 8th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of North 24 Parganas without the prior permission of the learned special court. Accordingly, CRM (NDPS) 80 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
