04.02.2026 Ct. No. 28 Sl. No.39 akd [ALLOWED] C. R. M. (A) 153 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed on 08.01.2026 in connection with Lalgola Police Station Case No.890 of 2025 dated 11.10.2025 under Sections 115(2)/117(2)/109/3(5) of the Bharatiya Nyaya Sanhita, 2023. (G.R. Case No. 4752 of 2025) And In Re: Minarul Sk. @ Minarul Saikh ... ... Petitioner Md. Bani Israil Mr. Adwityo Raha ... ... for the petitioner Mr. Arindam Sen Ms. Mousumi Sarkar ... ... for the State 1.

Heard the learned counsels for the parties.

2.

Perused the case diary.

3.

The prosecution case is that there was a scuffle between certain individuals leading to infliction of injuries but the same was not grievous in nature.

4.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail.

5.

Considering the above and the other materials available in the case diary and the fact that charge sheet has already been submitted, I am inclined to grant anticipatory bail to the petitioner. 6.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall

surrender before the learned jurisdictional court within four weeks from date and pray for bail and shall attend the jurisdictional court regularly. He shall not threaten and/or intimidate witnesses. 7.

The application for anticipatory bail is, thus, allowed. 8.

Urgent Photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Jay Sengupta, J.)
