AGP Mr. Sailendranath Chakraborty Ms. Sahina Sumi ....for the State 1) Report dated 26th November, 2025 of the Child Development Project Officer, Rajarhat ICDS Project, North Parganas being respondent no. 4 is placed before this Court and same is taken on record.
2) Matter is heard in presence of learned advocates representing the petitioner and State respondents.
3) Mr. Tapan Kumar Mukherjee, learned Additional Government Pleader representing State respondents has fairly submitted that if petitioner joins as Anganwadi worker in the concerned Anganwari Centre in that event petitioner will be permitted to function as Anganwadi worker and necessary steps will be
taken which would facilitate the petitioner to work as Anganwadi worker. It is also submitted that since petitioner is not attending the Anganwadi Center remuneration is not being paid to her.
4) Learned advocate representing the petitioner submits on instruction that petitioner is willing to join as Anganwadi worker in the Anganwadi center immediately.
However, it is submitted that unless the portal is revived attendance of the petitioner in Anganwadi Center will not be recorded and in spite of attending Anganwadi Center petitioner will be treated as absent.
5) Having considered the submissions made on behalf of the parties, Court directs the petitioner to join the Anganwadi Center as Anganwadi worker on 1st December, 2025.
Respondent no. 4 is directed to revive the portal on which petitioner will record her attendance. After joining of the petitioner as Anganwadi worker remuneration in accordance with law shall be paid to the petitioner on monthly basis.
6) However, it is submitted on behalf of the petitioner that though petitioner attended the Anganwadi center regularly as the portal was
not alive her attendance could not be recorded. Therefore, prayer is made for directing the concerned respondent authorities to pay arrear remuneration.
7) Considering such prayer made on behalf of the petitioner after her joining on 1st December, as Anganwadi worker petitioner shall be at leave to make a representation to respondent no. 4 seeking release of arrear remuneration by fortnight from the date of joining. If such representation is made by the petitioner within aforesaid time, respondent no. 4 shall decide the same in accordance with law after granting opportunity of hearing to the petitioner or her representative by eight weeks thereafter and a reasoned order shall be passed which shall be communicated to the petitioner by ten days thereafter. If it is decided by respondent no. 4 that petitioner is entitled to receive arrear remuneration, consequently concerned respondent authorities shall take step for immediate release of same.
8) Writ petition stands disposed of.
9) Leave is granted to learned advocate representing the petitioner to communicate this
order immediately to respondent no. 4 without waiting for server copy of this order.
10) There shall be no order as to costs.
11) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
