This is an application under section 482 of the Criminal Procedure Code , 1973 seeking quashing of the proceedings of DEBGR Case no. 10/2022, pending before the court of learned Chief Judicial Magistrate, Purulia which arose out of Purulia (T) police station Case No. 154/2022 dated 20.09.2022 under sections 379/411/413/414/120B of the IPC and section 7(1)(a)(i) of the Essential Commodities Act.

On the other hand, CD produced.

It appears from the CD the chargesheet being no. 133/2023 dated 30.08.2023 has been submitted against the petitioners under sections (i) 379/411/413/414/120B of the IPC and (ii) Essential Commodities Act, 1955, (iii)section 7(1)(a)(i) of the Essential Commodities Act (iv) and other Acts

and sections - 182A (iv)/190(ii)/196 Motor Vehicles Act against the petitioner and others.

This case pertains to the year 2023.

In spite of giving several opportunities, no one appeared on behalf of the petitioners, no accommodation sought for on behalf of the petitioners.

It seems the petitioners have no more interest to proceed with the instant case.

Accordingly, CRR 87 of 2023 is dismissed for default.

Interim order, if any, stands vacated.

Let a copy of this order be communicated to the learned court below immediately for information. Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
