Smt. Bhaswati Mitra The contempt petition has been filed alleging violation of the order dated 18th April, 2008 passed in WP 26859 (W) of 2006 with CAN 2032 of 2008. The order in question only grants the petitioner liberty to file a representation by 23rd April, 2008 and if such representation is filed, the respondent no.3 should dispose of the same by passing a reasoned order in accordance with law by 2nd May, 2008. Rule was issued against Smt. Bhaswati Mitra, the Controller of Examination and Acting Registrar of the Bengal Engineering and Science University, Shibpur, P.O. & P.S. Shibpur, Howrah on 7th January, 2009. The record reveals that the alleged contemnor had appeared before the Court on 20th February, 2009. It appears from the order dated 24th February, 2009 that affidavit-in-opposition was directed to be filed by 31st March, 2009 and reply, if any, thereto shall be by 17th April, 2009. No affidavits are on record.

The matter appeared in the list on 28th June, 2021 and was called on twice, but no one appeared on behalf of the petitioner. The matter is appearing in the list today marked as "Last Chance" with a note in the list that appropriate orders will be passed if no one appears in the matter. Even today no one appears in the contempt petition. No one has applied for joining in the virtual mode.

It appears that the parties are not interested to proceed further with the contempt petition. The same is disposed of without any further orders. Rule stands discharged accordingly.
