Mr. Nimesh Mishra Mr. Suddhastwa Banerjee Mr. Suman Saha Ms. Anupa Banerjee Ms. Sauchita Barman Ray .....for the petitioners Mr. Shiv Mangal Singh ......for the respondent Nos. 1-5 By the order dated 7th February, 2023, upon hearing counsel for the petitioners and the Bank, this Court had made it clear that the petitioners had challenged the very order before the Appeal Court which the petitioners now seek to impugn in the present writ petition. The petitioners have also sought for further orders namely, videography of the impugned minutes. It is not clear whether any such recording of the impugned minutes is in place. The Court had also recorded that since the petitioner are already before the Appeal Court, the petitioners can seek the same prayers before the Appeal Court and not pursue the remedies before this Court.

Learned counsel appearing for the petitioners submits that on the last occasion counsel could not pursue the matter before the Division Bench since the

counsel was engaged before this Court. The order produced by learned counsel appearing for the Bank dated 22nd February, 2023 shows otherwise. The Division Bench has recorded that the appeal was adjourned at the request of counsel appearing for the appellants (petitioners before this Court).

This Court is hence not inclined to entertain the writ petition. The petitioners have their recourse before the Division Bench.

WPA 548 of 2023 is accordingly dismissed without any order as to costs.
