The writ petitioner seeks benefits of a temporary engagement by the G. B. Construction for maintaining water supply facilities under the Domkol Gram Panchayet. The petitioner submits that on the pressure of the Panchayat, the said private agency is seeking to remove the petitioner from his job. He also claims that he has not been paid salary and emoluments for substantial period of time.

This Court is of the view that there is no public element involved in this matter as engagement of the writ petitioner is with a private agency. Such agency is engaged by the Gram Panchayat.

Accordingly, the writ petition is not maintainable. The writ petition is dismissed. It is made clear that dismissal of the writ petition shall not prevent any proceeding that the

petitioner may take out in a civil forum against the said G. B. Construction or its successors in interest. There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
