Ranaghat Women Police Station Case No. 121 of 2021 dated 26 October, 2021 was registered on the basis of a complaint made by one Ajay Roy alleging, inter alia, that the accused, a man of about 57 years sexual assaulted the torture of the defacto complainant, who is nine years of age. Learned Advocate for the petitioner has prayed for bail of the accused on the ground of his long detention in custody during investigation and secondly she has raised a question as to whether the incident as reported by the minor victim can take place on an open road in broad day light.

The learned P.P.-in-Charge has raised objection the prayer for bail on the basis of the statement of the victim recorded under Section 164 of the Code of Criminal Procedure.

Having heard the learned Counsels and on careful perusal of materials on record, this court is of the view that this is not a fit case for granting bail to the accused.

Therefore, prayer for bail is considered and rejected. ( Bibek Chaudhuri J.)
