The State of West Bengal & Ors.
Mr. Soumen Bhattacharya.
... for the petitioner.
Mr. Amal Kumar Sen.
... for the State.
Affidavit of service filed in Court be taken on record.
The matter relates to contract carriage permit (auto rickshaw). The petitioner filed this application in 2007. He submits that his application has not been considered till date despite an order passed by this Court in W.P. 18272(W) of 2010 dated 10th February, 2011. The petitioner submits that, subsequently there was a ban on issuance of permit but thereafter the ban was removed which he came to learn from an order passed by a Division Bench of this High Court in W.P. 23638(W) of 2017 dated 9th August, 2019. His grievance today is though there is no ban now, the said application of 2007 has not been considered even after lifting of the ban.
Mr. Amal Kumar Sen, learned advocate appeared in this matter to assist this Court and has submitted that
that the applications of 2007 has been rejected long back. The petitioner has submitted in view of such submission made by the respondent that he should be granted liberty to file afresh for contract carriage permit (auto rickshaw). Nobody is preventing him from filing new application for such permit and if he files such application within a period of four weeks from date, the same will be considered by four weeks in accordance with the present policy of the State after giving him an opportunity of hearing and communicate the decision to the petitioner within a period of two weeks thereafter With the above direction, WPA 637 of 2021 stands disposed of without any order as to costs.
