The grievance of the petitioner is directed against the refusal of the CESC Limited in providing a new separate service connection to the premises of the petitioner.

It is submitted on behalf of the petitioner that by the impugned communication dated 16 December 2020, the CESC Limited has rejected the application of the petitioner on the ground of "regret separate service". On behalf of the CESC Limited it is submitted that the petitioner has applied for a new connection where service already exists. It is also submitted on behalf of the CESC Limited that the petitioner has approached this Court with unclean hands and there has been gross distortion.

In view of the submissions made on behalf of the parties, WPA 639 of 2021 stands disposed of by directing the concerned Grievance Redressal

Officer (GRO) to consider the case of the petitioner in accordance with law.

Affidavit-in-Opposition filed by the CESC Limited be kept with the records.

It is made clear that there has been no adjudication on the merits of the case and all issues are left open to be decided by the GRO in accordance with law. Liberty is granted to the petitioner to make a separate representation before the concerned GRO within seven days from the date. If such application is made, the GRO is directed to dispose of the same within eight weeks from the date of receipt the same.
