Mr. Bhattacharyya, learned Senior Advocate appearing for the petitioner has drawn attention of this Court to a letter dated December 23, 2022 whereby the petitioner was asked to make his representation against the proposed suspension within ten days from receiving the communication.
Mr. Bhattacharyya, however, submits that the petitioner is willing to tender his apology in terms of the settlement arrived at between the representatives of the students and the University authority on January 5, 2023.
In that view of the matter, nothing needs to be decided in this writ petition. The petitioner will submit letter of apology within 48 hours from date to the
Proctor of the University. Upon acceptance of the apology letter, the University will refrain itself from taking any punitive action against the petitioner. Needless to mention the petitioner will be permitted to continue with his academic session. Mr. Jayanta Narayan Chatterjee, learned advocate appearing on behalf of the University has also consented to this order passed in the writ petition. Accordingly, WPA 551 of 2023 is disposed of.
There will be no order as to costs.
