The affidavit filed by the alleged contemnor discloses that Shyamcharan Mondal has been paid his wages upto September, 2019 and towards wages for October, 2019 although an account payee cheque has been prepared but the same has not been collected by Shyamcharan Mondal. Accordingly, we direct BSNL to issue a fresh cheque in favour of Shyamcharan Mondal for wages of October, 2019 and for any other period as he may be entitled within a fortnight from date and forward the said cheque or demand draft as the case may be to Mr. Jamiruddin Khan, Advocate for acceptance on behalf of Shyamcharan Mondal. In so far as Ajit Kumar Das is concerned it is stated that he was not engaged by contractor from 1st November, 2019 in BSNL. The relevant document has been produced in support of the said contention. In view thereof the claim of Ajit Kumar Das for any period after October, 2019 is not
admissible and not payable. However, it is stated that payments have been released to the contractor in relation to Shyamcharan Mondal and Ajit Kumar Das by BSNL authorities.
In view of the aforesaid, we dispose of this contempt application being CPAN 19 of 2021 by recording compliance of our order.
