WPA 668 of 2026 (Rasunera Begum & Ors. vs. State of West Bengal & Ors.) Mr. Avijit Gope .... For the Petitioners Mr. Rajarshi Basu K. M. Hossain .... For the State Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. Learned counsel for the petitioners submits that the accused against whom FIR has been lodged by the petitioners have assaulted the petitioners and forcibly taken possession of a portion of their property. The petitioners lodged complaint before the police authority in this regard and FIR has been registered. The accused are continuously threatening the petitioners and demanding withdrawal of the complaint. The petitioners seek police protection.
It appears from the report submitted by the State that the second petitioner lived together with one Rinku Laskar as a result of which she gave birth to a male child. The second petitioner refused to provide any social or financial recognition to Rinku Laskar and her child and upon intervention by local respectable persons, he married Rinku and acknowledged their relation.
The issue pertains to a marital dispute. Since the petitioners apprehend thereat to their life and property
by the accused, the police authority shall render necessary assistance/protection to the petitioners as and when sought and shall ensure that the petitioners are able to reside in their property peacefully and without any disturbance from any corner whatsoever. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
