The petitioner complains that the private respondent no.9 is a history-sheeter who is involved in pilferage of electricity as well as creating disturbance in peaceful enjoyment of the property of the petitioner.

Learned advocate appearing for the respondent no.9 submits that the petitioner happens to be a relation who after accepting money has turned volte face and is creating problem so that the petitioner cannot enjoy the property. Learned advocate appearing for the WBSEDCL submits that they would take steps in accordance with law.

Learned advocate for the State submits that if the electricity authority complains, the police authorities would take steps in accordance with law.

I find that the information was furnished with the police station on September 2023. Having considered that more than a year has passed since then, presumably there may be change of circumstances. Accordingly, I direct the petitioner to furnish a fresh information with the Inspector-inCharge, Burwan Police Station, Murshidabad. The concerned police station would act in accordance with law in respect of the accusations made by the petitioner and inform the outcome of consideration within a period of four weeks from the date of communication of this order.

In view of the inimical relationship existing between the petitioner and the private respondent no.9, the police authorities would keep a strict vigil and ensure that no breach of peace takes place at the locale.

With the aforesaid observations, the writ petition being WPA 532 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
