Father of a student of Class-X has approached this court with the present writ petition with the prayer to complete the process of enrollment which would permit the student to participate in the ensuing Madhyamik Examination, 2025 which will commence from 10th February, 2025.
It is submitted on behalf of the petitioner that the student took transfer on 6th January, 2023 from Sarisha Ramakrishna Mission Sikshamandir (H.S.), South 24 Parganas where he was studying in Class-IX and thereafter took admission in Madhyamgram P.M. High School (H.S.), Purba Bardhaman. Student passed Class-IX annual examination in Madhyamgram P.M. High School (H.S.). However during the period when the student was studying in Sarisha Ramakrishna Mission
Sikshamandir (H.S.), South 24 Parganas, on completion of formalities, Registration Certificate was issued in his favour. It is submitted that in spite of issuance of Registration Certificate unless formality relating to enrollment is complete with the assistance of the West Bengal Board of Secondary Education as well as the school authority where the student is presently studying, he will not be permitted to participate in the ensuing Madhyamik Examination, 2025.
Learned advocate representing the West Bengal Board of Secondary Education in reference to a notification dated 5th January, 2025 submits that as per the said notification last date for taking steps in order to enroll the student for Madhyamik Examination, 2025 was 7th January, 2025. It is also submitted that prior to the time which was accorded to the schools and students to complete enrollment in terms of notification dated 5th January, 2025 from 6th January 2025 to 7th January 2025, in two different phases opportunity was given to complete the process of enrollment, first phase concluded on 18th December, 2024 and the second phase concluded on 3rd January, 2025. According to the Board, in spite of three different opportunities, student or the school of the student did not take steps for enrollment. It is also submitted on behalf of the Board that correction of Registration Certificate wherein name of the
previous school is indicated, is not required since on completion of enrollment process all future testimonials relating to participation of the student in the ensuing Madhyamik Examination, 2025 shall be issued containing name of the present school, that is, Madhyamgram P.M. High School (H.S.), Purba Bardhaman.
On behalf of authority of Madhyamgram P.M. High School (H.S.), Purba Bardhaman it is submitted that effort was made by making representations to the concerned authority of the Board for completing enrollment of the son of the petitioner but the process could not be completed. However, nothing has been shown on behalf of the said school authority that steps were taken online to enroll the son of the petitioner. Without entering into the allegations and counter allegations which have been leveled by and between the Board and the authority of Madhyamgram P.M. High School (H.S.), Purba Bardhaman, it is required to direct the Board and the aforesaid school authority to take immediate steps to complete enrollment process in order to permit the son of the petitioner to participate in the ensuing Madhyamik Examination, 2025. On completion of necessary formalities and payment of late fee, the concerned authority of the Board shall enroll the
student on offline mode, as a special case, by seven (7) days from the date of communication of this order. Since it has already been submitted on behalf of the Board that after enrolling the student, all testimonials relating to participation of the son of the petitioner in ensuing Madhyamik Examination, 2025 shall be issued containing name of the present school, that is, Madhyamgram P.M. High School (H.S.), Purba Bardhaman, Board is not directed to issue fresh Registration Certificate incorporating name of the said school.
With the above directions, writ petition stands disposed of.
Liberty is granted to the learned advocates representing the parties to communicate this order without waiting for the server copy of this order to the Board for taking necessary steps.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
