Learned counsel for the petitioner has preferred the present writ petition seeking refund of the amount of Rs.40,791.00 from the respondent no.3.

It is the case of the petitioner that he had received a quotation from West Bengal State Electricity Distribution Company for a SMP connection. The petitioner had purchased the material for an amount of Rs.38,480/-. The petitioner had moved before the Ombudsman for the refund of the said amount.

The Ombudsman vide order dated 11.09.2015 had directed the respondent no.3 to refund the said amount on presenting the valid voucher to the petitioner.

It is the case of the petitioner that even though he received part payment but the complete payment has still not been made. The petitioner preferred a representation dated 22.11.2017 before the respondent no.3 which is still pending after a lapse of considerable period of time.

Learned counsel for the respondent states that he shall release the payment in terms of the order passed by the Ombudsman if the petitioner submits the purchase vouchers and his representation shall also be disposed of in terms of the order passed by the Ombudsman.

Let this exercise be completed within a period of eight weeks from the communication of this order. With the above direction, the present writ petition is disposed of.
