Report filed on behalf of the State is taken on record. Despite service, no one appears on behalf of the alleged victim. The prosecution case is that the petitioner used to disturb the 16 year-old victim girl on a public way. On the particular day, he again restrained her with his scooty and upon the victim refusing his marriage proposal, touched the minor victim inappropriately. Considering the above and the other materials available in the case diary including the statements of the minor victim and the statements of local witnesses supporting the prosecution case, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
