Memo of Evidence dated 03.03.2024 submitted by Mr. Kundu, learned advocate appearing for the state be kept with the record.

The said report submitted by SI, Sankrail Police Station is against the reflection from the records relating to Sankrail Police Station Case No. 215 of 2019 dated 16.03.2019 pending before the learned Judicial Magistrate, 3rd Court, Howrah. The grievance of the petitioners is that on 08.05.2023 date was fixed for recording of evidence of CSW-1 and 2 on 28.05.2023 and on 28.05.2023, the next date was fixed on 03.04.2024 for evidence. After 11 months date has been fixed by the learned Judicial Magistrate, 3rd Court, Howrah. Case was initiated in the year 2019.

I direct that henceforth the learned trial court would ensure that at least once in every three months date is fixed for the purposes of the case. Learned Public Prosecutor would take steps for the availability of the witnesses concerned by informing the Inspector-in-Charge, Sankrail Police Station. There are six witnesses relied upon by the prosecution out of which four witnesses are individuals and two happens to be the police officers. So far as the independent witnesses are

concerned, all efforts be taken so that whole of the evidence is completed before December, 2024.

With the aforesaid observations, the revisional application being CRR 93 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
