In Re : CAN 2 of 2024

1. CAN 2 of 2024 is moved praying for correction of some clerical error in Para 12 & 13 of the judgment dated 19.07.2024 and the cause title of the memorandum of appeal.

2. Accordingly, Para 12 & 13 of the said judgment be read as follows:- "Para 12. As, the claimant did not receive any compensation as granted by the tribunal, the claimant is thus entitled to the total amount of compensation of Rs. 2,79,500/- together with interest at the rate of 6%

per annum from the date of filing of the claim application till deposit.

Para 13. The Appellant/Insurance Company shall deposit the total amount, along with the interest, with the learned Registrar General, High Court, Calcutta, within a period of six weeks, who shall release the amount in favour of the claimant, upon satisfaction of his identity and payment of ad-valorem Court fees, if not already paid."

3. Para 12 & 13 of the said judgment are modified to the said extent and be read in place of Para 12 & 13 in the judgment dated 19.07.2024.

4. The name in the cause title be noted as 'Sahorap @ Sahorab Shah @ Saharap Shah'.

5. Rest of the judgment remains unchanged.

6. CAN 2 of 2024 is accordingly disposed of.

7. Copy of this order be sent to the Learned Tribunal, along with the trial court records, if received.

8. Urgent certified website copy of this order, if applied for, be supplied expeditiously after complying with all, necessary legal formalities.
