For the Petitioner Ld. advocate for the petitioner is aggrieved by the factum of false implication in connection with Behala P.S. Case No. 394/2019 dated 19.12.2019, wherein charge-sheet was submitted in the year 2021 under sections 323/354A/506/34 of the IPC.

Ld. advocate for the petitioner submits that the petitioner is a student of TATA Institute of Social Sciences and is a patient of Haemophilia.

I have considered the revisional application along with the enclosures and I find that none of the documents under section 207 of the cr.p.c. have been enclosed in the said application.

Accordingly, I am of the view that the petitioner would be at liberty to take up the issues so canvassed in the revisional application by taking out an appropriate application under section 239 of the cr.p.c. before the ld. jurisdictional court. The ld. Magistrate would consider the

same in accordance with law without being influenced by any of the observations made by this court.

With the aforesaid observations, CRR 92 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
