NB 11.01.2021 CRR 67 of 2021 Ct. No. 32 In the matter of:- Anirudhya Chakraborty ...petitioner Mr. Surajit Basu ...for the petitioner.

Mr. Swapan Banerjee, Mr. Mirza Firoz Ahmed Begg.

...for the State.

This is an application seeking expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 323, 341, 354B, 384 and 506 of the Indian Penal Code.

Let a copy of this application be served upon Mr. Swapan Banerjee and Mr. Mirza Firoz Ahmed Begg, learned Counsels who ordinarily appear on behalf of the State. Let them represent the State in this case. Their engagement may be regularised by the competent authority of the State in due course.

Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner admittedly had an affair with the de facto complainant. The prime allegation was that even after the breakup of the two, the petitioner did not stop pursuing the lady. Although the First Information Report was lodged in 2016 and the charge sheet was submitted in 2017, till date even the charges have not been framed. The next date has been fixed on 10th August, 2022. The proceeding has remained pending for no fault of the petitioner.

I have heard the submissions of the learned Counsels appearing on behalf of the petitioner and the State and have perused the revision petition.

No prejudice will be caused to anyone, if a direction for

expeditious disposal is passed in this case.

It appears that some delay has been caused in conducting the impugned proceeding.

In view of the above and in the interest of justice, the learned Trial Court is requested to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties. The learned Trial Court is further requested to prepone the next date of hearing and decide the issue of framing of charge/discharge at the earliest, preferably within a period of four months from the date of communication of this order.

With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
