Mr. Uttam Kumar Halder ...the petitioner (in person) Mr. Amal Kumar Sen, AGP Mr. Lal Mohan Basu ...for the State Mr. Sujit Sankar Koley Mr. Swagatam Deb ...for WBSEDCL It appears from the report of the Inspector-inCharge of Sonarpur police station signed on July 9, 2024 that Sonarpur PS Case No.699 of 2019 dated August 10, 2019 has not been investigated at all because of the callous and irresponsible act of the investigating officer. The report is taken on record.

The court was contemplating taking action against the said investigating officer but it has been submitted on behalf of the State that the said officer has since retired from service. The bailable warrant of arrest issued against the said officer is pending execution. In view of the above, the Superintendent of Police, Baruipur police district is directed to engage a competent officer, not below the rank of Deputy Superintendent of Police, to investigate the case and take necessary steps in furtherance thereto. The investigation shall be conducted in accordance with law and concluded at the

earliest.

The Superintendent of Police is also directed to ensure that the warrant of arrest issued against the retired investigating officer is duly executed. The writ petition stands disposed of.

Certified copy of this order, if applied for, shall be made available to the parties.
