Mr. Satyendra Agarwal Mr. Bijoy Bag .....for the petitioner Mr. Nilotpal Chatterjee Ms. Amrita Panja Moulick ......for the State It appears from the documents that on 27th June, 2022, this Court had directed the respondent No. 6 in WPA 11230 of 2022 being the Executive Engineer, Basirhat Irrigation Division to consider the representation dated 21st November, 2020 made by the petitioner and dispose of the same by passing a reasoned order within a period of four weeks after hearing all necessary parties.

Learned counsel for the State submits that the writ petitioner did not attend the hearing for the first few times and the concerned authority could not hence pass any reasoned order since the Court had directed the authority to pass the reasoned order only after hearing the parties. This is disputed by counsel appearing for the petitioner.

Counsel appearing for the petitioner seeks to bring all kind of facts which are not relevant at this stage.

This Court is of the view that the present writ petition can be disposed of by directing the respondent No. 6 being the Executive Engineer, Basirhat Irrigation Division to dispose of the petitioner's representation within a week from date.

WPA 587 of 2023 is accordingly disposed of with a direction on the respondent No. 6 to hear all necessary parties and dispose of the representation made by the petitioner on 21st November, 2020 within seven days from date. A copy of the reasoned order shall be made available to the petitioner. The petitioner shall co-operate with the authorities for the hearing as directed.
