It appears from the report of the District Inspector of Schools (S.E.), District:

24-Parganas (South), the respondent no.3 herein bearing Memo No. L.C./902 dated November 17, 2023 filed in compliance with the order dated October 10, 2023 that the prayer of the petitioner for compassionate appointment has been refused for her failure to file certificate of the Sabhapati of the concerned Panchayet Samity as required in terms of the Government Order No. 457-Edn(P) dated October 12, 1987.

Mr. Bari, learned Counsel for the petitioner prays accommodation to file such certificate before the respondent no.3 for reconsideration of her prayer for such appointment.

Mr. Chattopadhyay, learned Additional Government Pleader though has raised dispute with regard to the entitlement of the petitioner on the ground of delay but since the prayer of the petitioner has not been refused on

the said ground, at this stage, same is not taken into account.

However, the petitioner is granted liberty to file the necessary certificate before the respondent no. 3 within three weeks from date for re-consideration of her prayer for such appointment. The said respondent, while considering the said prayer of the petitioner, shall also take into account the ground of delay as raised by Mr. Chattopadhyay. The respondent no. 3 shall complete his drill in this regard within a period of four weeks from the date of receipt of the said certificate in accordance with law. W.P.A. 589 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
