Learned Advocate appearing for the petitioner submits that the period of detention of the petitioner should be considered. Learned Advocate appearing for the State draws the attention of the Court to the statement recorded under Section 164 of the Code of Criminal Procedure of the victim. He submits that all the other co-accused are yet to be arrested. This is the third application for bail by the petitioner. The first application for bail being CRM 5067 of 2021 was rejected on October 5, 2021. There the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure was considered and finding was returned. Implicating the petitioner and other un-named persons. The second application for bail being CRM 5107 of 2021 was not pressed on November 17, 2021. There is hardly any change in circumstances subsequent to the initial order of rejection dated October 5, 2021. Consequently, CRM (DB) 102 of 2022 is rejected. (Debangsu Basak, J.)
