(NDPS) No. 33 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bauria Police Station Case No. 46 of 2021 dated 02.04.2021 under Section 20(b ) of the NDPS Act and charge-sheet submitted under Section 20(b) of the NDPS Act.

And In Re : Sumir Pradhan ..... petitioner Mr. Mrityunjoy Chatterjee Mr. Debapriya Majumder ... for the petitioner Mr. T. D. Nandy Mr. Antarikhya Basu ... for the State Heard learned Counsels appearing for the parties. We have considered the materials on record. Statements of the witnesses and contemporaneous document i.e. seizure memorandum show recovery of narcotic substance i.e. 20.954 kgs. of Ganja from the possession of the petitioner and coaccuseds. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
