In the midst of hearing, Mr. Tanmoy Mukherjee, learned Counsel for the respondent submits that in the meantime the sole respondent having died, substitution is necessary. Mr. Mukherjee is requested to give particulars of legal heirs of the sole respondent including the date of death of the sole respondent as available with him to Mr. Bhattacharya, learned Counsel for the appellant or any of his junior to facilitate substitution in the meantime.

The matter is de-listed and it shall be listed on mention being made after filing of substitution petition.

It is made clear that on filing of the substitution petition, copy of the same shall be served on Mr. Tanmoy Mukherjee or any of his junior

appearing with him. Mr. Mukherjee, learned Counsel appearing for the respondent has the liberty to file objection, if any, to the petition for substitution.
