Petitioner submits that his power of attorney holder was subsequently assaulted pursuant to the initiation of the present writ petition.
To that effect, petitioner draws the attention of the court to a document wherein it reflects that Raghunathpur Police Station Case No. 10/24 has been registered.
Petitioner apprehends that the private respondents will flex their muscles and grab the property and the petitioner, being a senior citizen and not regularly residing over there, would loose her control over the property.
Learned advocate for the state is present.
Having considered that the police authorities have already registered a case against some persons who exceeded their lawful authority, I am of the
opinion that prima facie there exist certain disturbances.
It has been informed on behalf of the state that proceeding under section 107 of the Code of Criminal Procedure has been drawn up against the private respondents. The SDPO/Additional SP incharge of Raghunathpur Police Station will assess as to whether the private respondents are dangerous in nature and in case they are of such opinion, they will not only direct the Inspector-in-Charge to keep a strict vigil and or prevent breach of the peace but also would ensure that if there is a repeated offence committed by the accused, persons or the private respondents or the accused persons who have flexed their muscles with regard to the land in dispute, directions be passed against them to stay outside the jurisdiction of Raghunathpur Police Station.
With the aforesaid observations WPA 551 of 2024 is disposed of.
