This writ petition has been filed by the petitioner under Article 226 of the Constitution of India for allotment of FPS dealership licence in respect of area Thunthunia, Daspara, Chopra, Uttar Dinajpur.

Mr. S.P. Lahiri, learned advocate for the petitioner submits that the petitioner is one of the applicants in respect of FPS vacancy notice dated 18th October, 2022. The respondent no.4, Sub-Divisional Controller of Food and Supplies, Islampur Sub-Division after conducting an enquiry in relation to the application of the petitioner, till date, has not taken a decision with regard to the appointment of the petitioner. Hence, this writ petition. He seeks necessary directions be issued upon the respondent no.4, Sub-Divisional Controller of Food and Supplies, Islampur Sub-Division for completing the

selection process pertaining to the vacancy notification within a stipulated period.

Mr. Suman Sengupta, learned advocate for the State-respondents also submits that the directions may be issued to the respondent no.4, Sub-Divisional Controller of Food and Supplies, Islampur Sub-Division for completing the selection process for filling up of vacancy for advertised location.

Having heard the learned advocates for respective parties and considering the materials on record, the SubDivisional Controller of Food & Supplies, Islampur SubDivision, Uttar Dinajpur, being the respondent no.4, is directed to complete the selection process in respect of FPS vacancy notice under memo no.

1012/SCFS/ISP/2022 dated 18th October, 2022 in accordance with law within a period of two months from the date of communication of this order.

The learned advocate on record for the petitioner is directed to communicate this order to the respondent no.4, Sub-Divisional Controller of Food and Supplies, Islampur Sub-Division.

Since no affidavit has been invited, allegation contained in the writ petition shall be deemed not to have been admitted.

It is made clear that the Court has not gone into the merits of the case.

With the above directions, this writ petition being WPA 552 of 2024 stands disposed of along with all connected applications, if any.

There will be, however, no order as to costs. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of necessary legal formalities.
