Mukherjee ..... for the petitioner According to the learned counsel for the petitioner, the prayer in the present writ petition which is for direction on the respondent authorities to accept the applications along with requisite fees for grant of contract carriage permits in Route No. 35 Hazra More to Khidderpur More Via Gopal Nagar, Hastings Park, Belvedia Road, Alipur Road, Ekballpur Road, D.H. Road has been substantially addressed by an order of a coordinate Bench dated 4th March, 2021 in WPA 49 of 2020. By the said order, the learned single Judge directed the Secretary to the Government of West Bengal, Transport Department to instruct each and every Regional Transport Authority covered under Gazette Notification dated 10th December, 2018 to publish a notice every month with the number of vacancies within the jurisdiction of the RTA together with the cut-off date by which applications for grant of permits will have to be made by the interested

parties. Counsel submits that even though notice was published pursuant to the order on 3rd November, 2021, Route No. 35 does not find place in the said notice.

State is not represented.

Having regard to the above, WPA 3 of 2020 is disposed of with a direction on the respondent No. 2 being the Regional Transport Authority to publish the next Notice as directed by co-ordinate Bench having particular regard on whether there are resulting vacancies in Route-35. The requisite cutoff date shall also be mentioned in the notice so that the petitioner can make appropriate applications within the said date.

This order will be subject to the requisite Court fees being put in by the writ petitioner. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
