Mr. Aniruddha Chatterjee, Mr. Iftekar Munshi ... for the opposite parties. This revisional application has been filed challenging the order dated 08.12.2022 passed by the learned Civil Judge (Junior Division), Bidhannagar. Both the learned advocates appearing on behalf of the parties are present.

Learned advocate appearing on behalf of the petitioner/defendant No.3 has submitted that the order impugned was passed fixing 10th January, 2023 for written argument without disposing of the interlocutory application regarding exhibited documents.

Learned advocate appearing on behalf of the opposite party/plaintiff has submitted that there is no illegality in the order itself as the defendant/petitioner has every right to make necessary application for reconstruction of the documents, if lost, before the Trial Court.

Considering all facts and circumstances and after

perusal of the order impugned, I do not find any reason to interfere with this order.

This revisional application stands disposed of with liberty to file necessary application before the learned Trial Court with regard to the exhibited documents. All the parties shall act on the server copy of this order duly downloaded from the official web site of this Court.
