The petitioner's allegation is that his application for new permit in a route for contract carriage has not been accepted by the respondent authorities and his representation dated 4th September, 2019 at page 19 is required to be considered by the Secretary of Regional Transport Authority. Today at the time of hearing, the learned advocate for the State has come up with an instruction given by the said department signed by the Secretary of Regional Transport Authority, dated 20th January, 2021, which says that the office has not published as of now any notice inviting the application for offer letter in respect of the notified auto routes in which the petitioner is going to apply. It has further been intimated as instruction to the learned advocate that the

RTA Board in its meeting dated 30th December, 2020 has decided that in case of any vacancy arising in any route a notice inviting application from the public in general will be circulated widely in order to provide the maximum number of people with the opportunity of applying for the new offer letter.

A copy of the said instruction is kept on record as the Learned Advocates for the state wants to file it. After getting such information from the learned advocate for the State, I do not think this matter is required to be kept pending and the petitioner should take appropriate steps when the notification for inviting application from public will be published.

With this observation, this writ application is disposed of without any order as to costs.
