1. Matter is taken up for consideration when prayer is made on behalf of the petitioner to adjourn the matter on the ground of learned advocate.

2. However, State respondents are represented by learned advocate who has submitted a writing dated 18th June, 2025 issued by the District Inspector of Schools (SE) Purba Mednipur being respondent no. 3 and same is taken on record. On perusal of same it appears that District Inspector of Schools by memo dated 18th June, 2025 requested the Additional District Inspector of Schools (SE) Contai Sub-Division to decide the claim of the petitioner for sanction of postgraduate scale of pay in terms of the judgment delivered by the Special Bench dated 7th February, 2024 on a batch of writ petitions first one being WPA 9921 of 2007 (Utpal Kanti Karan Vs. State of West Bengal & Ors.).

3. Therefore, it appears that issue is pending before the Additional District Inspector of Schools (SE) Contai Sub-Division being respondent no. 4.

4. Hence respondent no. 4 is directed to take decision on the claim of the petitioner to sanction postgraduate scale of pay following ratio of Utpal Kanti Karan (supra) by 4 (four) weeks from the date of communication of this order. A reasoned order shall be passed by the respondent no. 4 after granting opportunity of hearing to the petitioner or his representative. The decision to be taken by the respondent no.

shall be communicated to the petitioner by 10 (ten) days thereafter.

5. Writ petition stands disposed of.

6. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
