Petitioner remains unrepresented. The Union of India being the opposite party is represented by the Learned Additional Solicitor General.

Mr. Dastoor, Learned Additional Solicitor General rightly has pointed out that the petitioner has sought for conclusion of the trial of the case within a specific period of time expeditiously.

It is also submitted by Mr. Dastoor that in connection with N.D.P.S. Case No. 34 of 2018 there are in all six accused persons and out of them three accused are absconding. The petitioner and other two accused are in custody. Therefore, the grievance of the petitioner can be meted out and justice will be sub-served if the Learned Trial Judge be directed to split up the case record and commence trial in respect of the accused person in custody.

I am in agreement with the submission made by the Learned Additional Solicitor General. Accordingly, the instant criminal revision is disposed of directing the Learned Additional Sessions Judge, 2nd Court, Jalpaiguri, designated as

N.D.P.S. Court at Jalpaiguri to split up the case record and commence trial against the petitioner and other two accused persons in custody at the earliest immediately on receipt of the copy of this order.

The Learned Registrar, Judicial Service is requested to send a server copy of this order to the Learned Judge, N.D.P.S. Court at Jalpaiguri for information and compliance. The instant revision is, thus, disposed of.
