The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with Lalgola P.S. Case No. 196 of 2020 dated 12.05.2020 under Sections 498A/304B/302/34 of the Indian Penal Code, 1860 (G.R. Case No. 1304 of 2020). The learned advocate appearing for the petitioner submits that the petitioner is in custody for 247 days. Upon completion of investigation, charge-sheet has already been filed and as such further detention of the petitioner is not necessary.
The learned advocate appearing for the State opposes the prayer for bail and draws our attention to several documents in the case diary.
Having heard the learned advocates and considering the materials in the case diary, the post mortem report and
the extent of complicity of the petitioner in the alleged offence, we are not inclined to grant bail at this stage. The application for bail being CRM 295 of 2021 is, thus, dismissed.
